Judge sheds a tear for Anna Nicole

The guardian of Anna Nicole Smith's baby daughter was awarded custody of the ex-model's body in a bizarre end to a six-day court case.

Lawyer Richard Milstein, who is looking after five-month-old Dannielynn Smith, should decide where the ex-Playboy model is buried, Judge Larry Seidlin ruled, as he broke down and wept.

The judge said he wanted Smith laid to rest in the Bahamas next to her son Daniel but did not make an order to that effect.

Judge Seidlin added: 'I want her buried with her son in the Bahamas, I want them to be together. She is going to be with her son. Her son is going to be next to her.'

Clearly overwhelmed, he dabbed at his eyes with a tissue, saying: 'She had to endure years of this kind of exposure. I get a week of it and it's ready to flatten me.'

His decision came after a hearing which saw him compare Smith to Shakespeare's Ophelia. The former Playboy Playmate, who married an elderly oil billionaire in 1994, died on February 8 in Florida.

Her death has led to a struggle between her estranged mother, Virgie Arthur, and her partner, Howard Stern, over her burial.

The matter was further complicated by the evidence of Smith's ex-lover Larry Birkhead, who says he is the baby's father.

Judge Seidlin heard evidence from all three, plus witnesses including a former bodyguard and Smith's ex-husband Billy.

Mr Smith testified via mobile phone, saying he thought Smith would have wanted to be buried next to Daniel in the Bahamas, where he died last year.

The issue of who fathered Dannielynn has still to be decided by a second court in California.
