Dog laws changed after fatal mauling

Dog owners whose pets savage people on private property could be jailed for two years under changes unveiled today.

Until now police could not make any charges for an attack that took place on private property, but new legislation will remove owners’ immunity from prosecution in such cases.

The announcement comes two weeks after teenager Jade Anderson was mauled to death by a friend’s dogs in the north of England.

Ministers say the changes, first mooted in February, will also give protection to healthcare, postal and other workers who visit private properties.

Minister Lord de Mauley said: “Out-of-control dogs are just as much a threat on private property as in public places.

“We are extending the law so that owners who allow their dogs to be dangerously out of control anywhere can be brought to justice.”

The changes will mean owners can be prosecuted if they fail to stop their dogs attacking someone on any private property, with sentences including an unlimited fine and up to two years in jail.

Attacks on guide dogs will also be covered by the new legislation. However, there will be no protection for burglars attacked by a householder’s dog.

Jade Anderson’s family started a campaign for a change in the law after she was killed by two bull mastiffs and two Staffordshire bull terriers, which set upon her at a house in Atherton, near Wigan. Under the changes proposed by the Government, courts will be able to take into account the character of an owner as they take action to tackle irresponsible ownership.

Meanwhile when a banned breed is identified, its owners will be able to apply to have it made exempt from being put down.

In assessing the application, the court will consider the character of the person in charge as well the temperament and past behaviour of the dog.
